Oregon Deposit and Application-Fee Rules That Protect You

Oregon caps what a landlord may charge to screen you. Under ORS 90.295, an applicant screening charge cannot exceed the landlord's average actual cost of screening or the customary amount charged by tenant-screening or credit-reporting companies, and a landlord may only collect one screening charge from you within any 60-day period regardless of how many of their units you apply for. The landlord must give you a receipt for the charge. A demand for a large, round-number application fee with no receipt and no screening report is a warning sign.

On deposits, ORS 90.300 requires the landlord to give you a receipt for any security deposit you pay and to return the deposit, or a written accounting of any amounts kept, within 31 days after you move out and hand back possession. Deductions are limited to unpaid rent and damage beyond ordinary wear and tear. A landlord who wrongfully withholds a deposit can be liable to the tenant for up to twice the amount wrongfully withheld. Oregon does not set a statutory dollar cap on the deposit itself, but a landlord cannot impose a new or increased deposit during the first year of your tenancy (absent an agreed change such as adding a pet), so treat any mid-lease demand for more deposit in that first year as improper.
