Wisconsin Deposit and Application-Fee Rules Worth Knowing

Wisconsin does not cap the dollar amount of a security deposit, so a demand for a large deposit is not itself illegal. However, state rule ATCP 134.05(2) prohibits a landlord from accepting any earnest money or security deposit from an applicant until the specific unit being considered has been identified to that applicant. Application-fee rules are also concrete. Under ATCP 134.05(4), a landlord may charge you only their actual cost for a nationwide credit report, capped at the amount in Wis. If you provide a credit report less than 30 days old from a nationwide agency, the landlord cannot charge you for another.
